Terms of Service
The agreement between you and ENODEUS

This document should be reviewed by a qualified lawyer before production use. These Terms govern use of the ENODEUS platform by Inspectors, Managers, and Company accounts.
1. Acceptance of terms
By creating an account or using ENODEUS (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of the Service
ENODEUS is a B2B industrial inspection management platform providing:
- NDT AI Module: AI-assisted analysis of NDT inspection images (powered by a YOLOv8-based computer vision model) for liquid-penetrant (PT) and other methods. The AI is an assistive tool only — it does not replace the professional judgment of a certified inspector and does not make accept/reject decisions.
- NDT Asset Traceability: Management of industrial assets with QR-code tracking, inspection history, Non-Conformance Reports (NCRs), Corrective and Preventive Actions (CAPAs), and immutable audit trace logs.
- Team Management: Work Orders, messaging, groups, and project management between Inspectors, Managers, and Company accounts.
- Report Generation: PDF inspection reports compliant with industrial standards (ASME, ISO, EN, API).
- Other modules (Welding, Calibration, Electrical, Construction, etc.) do not use AI models.
3. User roles and accounts
- Inspector (Freelancer): Individual professional. Free plan. Uses the platform independently without belonging to a company.
- Manager (Jefe): Team lead. Free role. Joins a Company via invite code. Manages inspectors and work orders within that company.
- Company (Empresa): Organization account. Requires a paid subscription (see Section 5). Creates the company, invites Managers, and has visibility over all inspections, assets, NCRs, and work orders within the organization.
- You must be at least 18 and a professional involved in industrial inspection or quality management.
- You are responsible for your account credentials and all activity under your account.
- You agree to provide accurate and current information.
- Each account belongs to one person. Sharing credentials is not permitted.
4. Professional responsibility
- AI results are indicative only and must be validated by a certified ASNT, EN 4179/NAS 410, or equivalent Level II or III inspector.
- ENODEUS does not certify, approve, or reject any component, weld, or structure.
- Final disposition is the sole responsibility of the qualified inspector and their organization.
- You will not rely solely on the Service for any safety-critical decision.
- NCR and CAPA records generated through the Service are management tools and do not constitute official quality certifications unless validated by your organization's QMS.
5. Subscription and payment
- Inspector (Freelancer): Free. No subscription required for core inspection and reporting functionality.
- Manager (Jefe): Free. No subscription required. Managers join a Company via invite code.
- Company (Empresa): 15-day free trial, then USD 99/year (or as displayed in the app). Required to create and maintain a Company account, invite Managers, and manage team-wide assets and work orders.
- Subscriptions renew annually until cancelled. You may cancel anytime; Company access continues until the end of the paid period.
- Fees are non-refundable except where required by law.
- Payments are processed by Stripe. ENODEUS does not store payment card details.
6. Industrial data and traceability NEW
- Immutable audit logs: Trace logs associated with NDT assets are append-only and cannot be deleted or modified, even by the user who created them. This is by design to comply with industrial audit trail requirements under NDT standards.
- Company data ownership: Asset records, NCRs, CAPAs, and inspection history created under a Company account belong to that Company. Individual inspectors may lose access to this data if they leave the company.
- Confidentiality: You are responsible for ensuring that inspection data you upload does not violate confidentiality agreements with your clients. ENODEUS is not responsible for data you share with unauthorized parties through the platform's sharing features.
- Report accuracy: You are responsible for the accuracy of all data you enter into inspection reports. ENODEUS does not verify the accuracy of manually entered parameters.
7. Acceptable use
- No unlawful use or breach of confidentiality obligations to third parties.
- Do not upload content you have no right to upload.
- You represent and warrant that you own, or have obtained all necessary rights, licenses, and consents for, any photo, video, or other content you upload to the Service.
- Do not reverse-engineer, copy, or resell the Service or its AI models.
- Do not disrupt the integrity or performance of the Service.
- Do not attempt to circumvent role-based access controls or security rules.
- We reserve the right to remove, disable, or refuse to process any content that violates these Terms, without prior notice.
8. Intellectual property
All rights in the Service, software, AI models, and ENODEUS brand are our exclusive property. You retain ownership of your uploaded data and grant us a limited license to process it to provide the Service (and, only if you opt in, to train our models).
9. Limitation of liability
To the maximum extent permitted by applicable law: ENODEUS, its founder, and any contributors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunity, arising from or related to (a) reliance on any AI-generated result; (b) any inspection, accept/reject, or safety-critical decision; (c) use of the Service outside its intended scope; (d) content uploaded by you or any other user; or (e) loss of access to company data following account termination or subscription cancellation. The Service is provided "as is" and "as available," without warranties of any kind. Total aggregate liability shall not exceed the amount you paid in the twelve (12) months preceding the claim, or USD 100, whichever is greater. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
10. Indemnification
You agree to indemnify ENODEUS from claims arising out of your use of the Service, your violation of these Terms, your violation of third-party rights or confidentiality obligations, or any inspection decision made using the Service.
11. Termination
We may suspend or terminate access for violations. Upon termination of a Company subscription, the Company account and associated data may become inaccessible. Disclaimers, liability limits, and IP provisions survive termination.
12. Governing law
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles. Disputes are subject to the competent courts of Switzerland. Mandatory consumer protections under your local law remain available to you and are not limited by this Section.
13. Changes
We may update these Terms. Material changes will be communicated through the app or by email. Continued use after changes constitutes acceptance. The current version is always available at enodeus.ch/terms.html.
